UNACCEPTABLE: Legal Loophole Sparks Anger After Convicted Migrant Offender Allowed To Stay In UK

A Swedish appeals court has decided not to deport a 19-year-old Eritrean national convicted of raping a 16-year-old girl, ruling that the assault was not lengthy enough to qualify as an “exceptionally serious offence”. Swedish law only permits deportation if the crime is “exceptionally serious” and poses a public safety risk.
The decision not to deport Yazied Mohamed, who assaulted the girl, has sparked widespread outrage across Sweden. A 16-year-old girl was attacked while walking home through a pedestrian tunnel in Skelleftea after missing her bus following a shift at McDonald’s. The suspect, Mohamed, allegedly stole her phone, dragged her into the tunnel, and assaulted her before she managed to escape.

Mohamed was sentenced to three years in jail by the Court of Appeal and ordered to pay 240,000 kronor (around £17,500) in damages to the victim. Prosecutors pushed to deport the convicted rapist, but his removal was rejected, as reported by GB News.
“Rap3 is, in many cases, considered an exceptionally serious offense that could lead to the deportation of a refugee, but an assessment must be made based on all circumstances in the individual case,” the court said.
It added: “Given the nature and duration of the offense in question, the Court of Appeal finds that while the crime is serious, it does not constitute an exceptionally serious offense that would warrant a deportation order for Yazied Mohamed. The request for deportation is therefore rejected.”
The girl and her family reported the attack immediately, but Mohamed was initially acquitted for a “lack of evidence”.
The girl spotted Mohamed again on her first day back at school, deepening her trauma.
“I want to say that I hate him and that he has destroyed me,” she told local media.
Former Chancellor Nadhim Zahawi wrote on X: “An injustice done to the poor girl & her family. A mad judgement, deport this criminal, Sweden wake up!
“Wrong side of history, if the law is an ass, then change the law.”
Reacting to the ruling, D0nald Trump Jr, in a post on X, wrote: “What the hell is going on in this world? Europe is at ‘Well, it was only a short rap3’ so we won’t get rid of a total piece of s…in our country. Wake up people, we are virtue signaling ourselves into extinction!”
The incident has a broader pattern. For example, an Eritrean man with 196 criminal charges, including assaults on police officers and inmates, was ruled in July 2025 not to face deportation. Additionally, four Eritrean men involved in a 2022 gang rap3 case also avoided removal from the country.
