Prince Harry’s ongoing US immigration records dispute has sparked fresh speculation over whether it played a role in his and Meghan Markle’s unexpected return to Britain.
The Duke and Duchess of Sussex recently left California and moved back to the UK with their children, Prince Archie, seven, and Princess Lilibet, five, who are reportedly now enrolled in British schools.

Now, TalkTV guest Nile Gardiner has suggested Harry’s immigration situation could have been an important factor behind the decision.
“I do believe that this very important issue of Harry’s immigration records has been an important factor in the background of the Sussexes’ decision to leave the United States,” Gardiner said during a discussion with presenter Kevin O’Sullivan.
Visa Records Case Fuels Questions
The speculation comes amid an ongoing Freedom of Information Act case involving records connected to Harry’s US immigration history.
According to a report cited by the source, the US State Department had been reviewing hundreds of documents linked to the case.
At the end of July, an initial group of 18 responsive records was identified but withheld in full.
A joint status report filed in a Washington, D.C. district court stated: “This case stems from a Freedom of Information Act (‘FOIA’) request that Plaintiffs submitted to the Department for records regarding Henry Charles Albert David, also known as ‘the Duke of Sussex’ or ‘Prince Harry.’”
It continued: “The State Department made its first interim production in this case on July 30, 2026, in which it identified 18 responsive records, all withheld in their entirety.”
The source also reported that 307 documents totalling 2,487 pages were under review, with none expected to be publicly released at that stage.
Importantly, the withholding of those records does not establish that Harry violated immigration rules or that his legal status in the United States was in jeopardy.
Gardiner Calls Move ‘Sudden and Surprising’
Gardiner nevertheless argued that the timing of the Sussexes’ return raised questions.
“It’s one of several key factors that are in play,” he said. “After all, this is a very sudden and surprising decision.”
He also claimed King Charles had only learned of the move shortly before it became public and that Prince William had been “completely blindsided.”
Those assertions were presented as part of Gardiner’s commentary and were not independently confirmed in the source.
He continued: “This is an extraordinary decision taken by the Sussexes, and you have to ask why they have made this incredible decision.”
Gardiner also offered a sharply critical assessment of Harry and Meghan’s popularity in both Britain and the United States.
